Terms of Use

EverlySpark provides personal color education, browser-based analysis tools, palettes, and editorial content as styling guidance. Results are estimates that may vary with lighting, cameras, displays, source photos, and interpretation. The service is not medical, dermatological, biometric identity, psychological, legal, financial, or other professional diagnosis or advice.

You must be legally capable of agreeing to these terms. EverlySpark is not intended for legal minors to use independently. A legal minor should not submit photos or other personal information unless a parent or guardian has reviewed the service, consented to the use, and is supervising it.

You may use the service for lawful personal purposes. Do not interfere with the site, bypass security controls, introduce malicious code, scrape at a harmful rate, misrepresent EverlySpark output, infringe another person's rights, or use the service for unlawful discrimination or identity decisions.

You retain your rights in photos you select. You represent that you have the necessary rights and consent to use each image, including permission from any identifiable person shown. Do not submit intimate, unlawful, or highly sensitive images. The current analysis flow processes selected photos in the browser and does not upload them to an EverlySpark server.

The service, branding, original text, visual design, software, and other EverlySpark materials are protected by applicable intellectual-property laws. Except where law permits otherwise, you may not reproduce, sell, republish, or create a competing dataset from substantial parts of the service without written permission. Product names and trademarks belong to their respective owners.

EverlySpark may link to third-party retailers, resources, and services. Some links are affiliate links that may generate a commission at no additional cost to you. We do not control third-party availability, pricing, policies, products, or claims; your dealings with them are governed by their terms.

The service is provided on an “as available” basis. To the maximum extent permitted by applicable law, EverlySpark disclaims warranties that the service will be uninterrupted, error-free, perfectly accurate, or suitable for every purpose. Nothing in these terms excludes a warranty or consumer right that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, EverlySpark is not responsible for indirect, incidental, special, consequential, or reliance-based losses arising from use of the service, styling decisions, third-party products, or unavailable features. This limitation is subject to mandatory rights and remedies available under applicable Canadian law.

We may modify, suspend, or discontinue all or part of the service, restrict abusive access, or update these terms. Material changes will be reflected by the updated date. Continued use after an update means acceptance where applicable law allows.

These terms are governed by the applicable laws of Canada, without limiting mandatory consumer protections that apply where you live. If one provision is unenforceable, the remaining provisions continue in effect. A delay in enforcing a provision is not a waiver.
